Terms of Use

1.Definitions

Certain words in this Terms of Use have a specific meaning and are explained below for Your easy understanding:

1.1 "Application" means the GuruKool application owned by ZBEL to provide the Content on Devices, which is available on various platforms such as iOS, Android and supported web browsers, etc.

1.2 "Content" means all text, graphics, images, music, software, audio, video, information or any other materials available on GuruKool Services.

1.3 "Devices" means any and all internet-enabled devices like smartphones, tablets, laptops, desktops, etc. which are compatible with and have access to the Internet.

1.4 "Internet" shall mean the system making use of the TCP/IP software protocols known as the internet or the worldwide web, whatever the communications links may be, which connects the End User (including by way of fixed, mobile, DSL, ISDN, UMTS, WiMax or other broadband links), including any developments in such protocols or any other protocols which may be developed which give equivalent, reduced or enhanced functionality compared with such protocols.

1.5 "Subscription Package" and/or "Subscription" means a package comprising one or more microdrama titles, episodes, seasons, series, short-form video content, or any other audio-visual, information or entertainment-based content made available to users on GuruKool Services for access during a specified subscription period at a price determined by ZBEL in its sole discretion.

2.Eligibility

2.1 Unless otherwise specified, GuruKool is available for individuals who have attained the age of majority in their respective jurisdiction. You may only access GuruKool Services in accordance with the applicable laws which enable a minor in Your jurisdiction to access such Site and services. By browsing and/or downloading and/or installing and/or using GuruKool Services, You represent and warrant that You are of majority age. In case You are a minor in accordance with the applicable laws based on Your jurisdiction, minors may access, browse or download the Application and/or Site and/or GuruKool Services only on the basis of parents' and/or guardians' authorization. All references made hereunder shall automatically be deemed to mean and include the parent and/or guardian on behalf of the minor, and such parent and/or guardian of the minor shall continue to be bound by all the Terms of Use on behalf of the minor.

2.2 In the case of India, this service is restricted to End Users who are aged 18 years or older. In India, by browsing or downloading and/or installing and/or using the GuruKool Services, You represent and warrant that You are 18 years of age or older. Minors may access, browse or download GuruKool Services only on the basis of parents' and/or guardians' authorization. All references made hereunder shall automatically be deemed to mean and include the parent and/or guardian on behalf of the minor, and such parent and/or guardian of the minor shall continue to be bound by all the Terms of Use on behalf of the minor.

2.3 SOME CONTENT OFFERED ON THE GuruKool SERVICES MAY NOT BE SUITABLE FOR SOME VIEWERS AND THEREFORE VIEWER DISCRETION IS ADVISED. ALSO, SOME CONTENT OFFERED ON THE GuruKool SERVICES MAY NOT BE APPROPRIATE FOR VIEWERSHIP BY CHILDREN. PARENTS AND/OR LEGAL GUARDIANS ARE ADVISED TO EXERCISE DISCRETION BEFORE ALLOWING THEIR CHILDREN TO ACCESS CONTENT ON GuruKool SERVICES. Your access to and use of the GuruKool Services is subject to these Terms of Use, and all applicable laws, rules, and regulations.

3.Your Responsibilities

3.1 You will be solely responsible for obtaining and maintaining the Device and Internet connection needed in order to access and use GuruKool Services, and for paying all charges in relation thereto. Internet charges will depend on the plan subscribed by You from Your internet service provider. GuruKool Services is compatible with selected operating systems, specific versions, and Device(s). The download procedure of the Application shall be subject to the process specified by the operating system of Your Device(s). You need a Device connected to the Internet for the download of GuruKool Services to begin and complete. ZBEL shall not be responsible in case of any fluctuation in Internet connection speed leading to corruption of the Application file download, or any delayed or defective download of the Application on Your Device(s). ZBEL shall not be responsible or liable to You for interruption, disruption, or deactivation of GuruKool Services on account of any Force Majeure Event. For the purpose of these Terms of Use, "Force Majeure Event" shall mean any event beyond the reasonable control of ZBEL, including but not limited to acts of God, any act or omission of government or quasi-government agencies, lock-out, strike, curfew, technical errors, etc. ZBEL may, at its sole discretion, make bug fixes and updates for the installed Application. In the event ZBEL upgrades the Application or any features thereof, You will be required to update Your Device in order to make it compatible with such upgrades. ZBEL shall not be responsible or liable to You in the event You are unable to access GuruKool Services or view the Content on GuruKool Services due to Your failure to upgrade Your Device.

3.2 The Content contained or available on GuruKool Services is protected by copyright, trademark, patent, trade secret and other laws, and shall be used only as provided in these Terms of Use, without written permission of ZBEL.

3.3 GuruKool Services does not provide legal, financial, investment, tax, accounting, medical, healthcare, psychological, employment, career counselling, governmental, regulatory, or other professional advisory services. Content made available through the GuruKool Services — including videos, microdramas, stories, explainers, simulations, educational materials, AI-generated content, AI-assisted content, and other informational resources — is provided solely for general informational, educational, awareness-building, and entertainment purposes.

3.4 All Content made available on GuruKool Services including, but not limited to, personal finance, investments, banking, insurance, taxation, health and wellness, career development, job opportunities, technology, English-speaking skills, government schemes, public benefits, sarkari services, compliance requirements, registrations, licenses, permits, or similar subjects should not be construed as professional advice or a substitute for consultation with qualified professionals or official authorities.

3.5 You are solely responsible for evaluating, verifying, and relying upon any information made available through GuruKool Services. Before making any decision, You should independently verify the relevant information and seek advice from appropriately qualified professionals where necessary.

3.6 ZBEL expressly disclaims any responsibility or liability arising from any reliance placed on the Content, or from any action taken or not taken based on the Content made available through the GuruKool Services.

4.Registration of End Users

4.1 You may register Yourself as an End User of GuruKool and become a registered End User of the GuruKool platform ("Registered End User"). During the registration process, You, as a Registered End User, are required to create an End User name (using Your mobile number) and password.

4.2 As a Registered End User, You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. ZBEL reserves the right to suspend or terminate Your registration as a Registered End User without assigning any reason (including for provision of inaccurate, not current, or incomplete information during the registration process or thereafter). As a Registered End User, You shall be responsible for safeguarding Your password and for all transactions undertaken using Your End User name and password. You agree not to disclose Your password to any third party and to take sole responsibility for any activities or actions under Your account, whether or not You have authorized such activities or actions. It is Your sole responsibility to change Your password immediately if You believe it has been compromised. ZBEL will not be responsible for any financial loss, inconvenience, or mental agony resulting from misuse of Your End User name and password under any circumstances.

5.Subscription Services

5.1 Some Content is only available to End Users who avail Subscription Packages. Any Registered End User can avail a Subscription Package. As a subscription-based End User, You will be required to subscribe to Subscription Packages made available by ZBEL from time to time, which may be subject to additional terms specified by ZBEL. Depending on the package and/or value-added services and the proposed subscription term, You will be required to make online payments through Your credit card, debit card, net banking account, cash card, or any other authorized payment mode made available for accessing and browsing GuruKool Services. The facility for online payments is available for selected cards, accounts and cash cards only. If You wish to continue availing GuruKool after the expiry of the initial term of a Subscribed Package, You shall, prior to expiry of such term, recharge Your account with the then-prevailing subscription charges.

5.2 ZBEL reserves the right to modify or discontinue GuruKool at its sole discretion, with or without notice to You, and shall not be liable to You or any third party in any manner should it exercise this right. Further, ZBEL reserves the right, at any time, with or without notice and without any liability, to:

1. replace or otherwise withdraw Subscription Packages or Content;
2. change or reduce the number of hours of any Content;
3. blackout any Content;
4. insert advertisements in the Content, as deemed fit, at its sole discretion; and
5. modify the prices for Subscription Packages or any part of the GuruKool service. Further, ZBEL reserves the right to change packaging and introduce base and add-on packages and/or offer channels on an a-la-carte basis.

You acknowledge and agree that Content provided by ZBEL as part of GuruKool Services can be removed at any time at ZBEL's sole discretion. Additionally, ZBEL shall have the right, but not the obligation, to refrain from providing any Content in the interest of national security, in the event of an emergency, war or similar situation, or if the Content is anti-national, promotes political/religious propaganda, is against public policy, is banned or restricted from distribution under applicable law, or if ZBEL otherwise determines it to be objectionable, obscene, derogatory to any person or class of persons, hurtful to the religious sentiments of any group, infringing on the privacy rights of any individual(s), or not in the interest of ZBEL's End Users or the general public.

5.3 In any credit card, debit card, net banking, cash card or other transaction, You must use Your own payment instrument. You acknowledge that You may be redirected to an external payment gateway page, which may itself redirect You to other third-party websites; ZBEL does not control such websites and is not responsible for transactions on them. ZBEL will not be liable for any card or account fraud and will not entertain related grievances — such issues should be communicated to Your bank, mobile carrier/operator, or wallet provider. ZBEL shall not be responsible for any dispute relating to online payments made by You. Further, ZBEL will not be responsible for any financial loss, inconvenience, or mental agony resulting from misuse of Your card, account or other payment details. Payments once made shall not be refunded under any circumstances. You are advised to keep Your card and net banking details confidential and not share them with any third party.

Subscription plans on GuruKool Services may include different types of access: (a) free access with advertisements, (b) ad-supported subscription plans, and (c) ad-free plans. ZBEL reserves the right to include advertisements or promotional placements within the GuruKool Services and/or Content, irrespective of subscription type and subject to applicable laws. Such advertising may appear as: (a) content-based ads such as pre-rolls, mid-rolls, post-rolls, overlays, pause ads, and branded integrations; and/or (b) platform-based ads such as masthead banners, home screen or navigation bar placements, sponsored tiles or carousels, interactive ad units, and contextual recommendations. Certain content categories may include advertisements even under an ad-free subscription plan. The nature, frequency and placement of advertisements may vary across devices, platforms and regions, and are subject to change at GuruKool's sole discretion.

5.4 If You have an active subscription plan and request deletion of Your GuruKool account in line with the terms mentioned in our Privacy Notice , You will immediately lose access to Your active subscription plan and any associated features. To avoid such interruptions, You must disable Your auto-recurring payment method as outlined in Clause 5.5 below, or let Your Subscription Plan expire prior to requesting deletion. If You disable the auto-recurring payment method, You may subsequently request deletion of Your account in line with the GuruKool Privacy Notice. If You request account deletion prior to the expiration of Your current active Subscription Plan period, the deletion process shall be initiated and You will lose access to Your active Subscription Plan. Under no circumstance will You be entitled to a refund of any portion of the Subscription Fee paid for the unexpired period, and You agree to waive any legal or equitable rights or remedies You may have against ZBEL with respect to such amounts.

5.5 If You have requested deletion of Your GuruKool account and are subscribed via an auto-recurring payment method (Apple IAP, Google IAP, Amazon IAP, Roku Pay, etc.), please ensure that such method is disabled prior to initiating account deletion — failing which You will continue to be charged. If ZBEL receives any payments through Your auto-recurring payment method after such a deletion request, You will not be entitled to any refunds, and You agree to waive any legal or equitable rights or remedies You may have against ZBEL with respect to such amounts. 5.6 GuruKool Services is available in select countries only. ZBEL would not be held responsible for hindrances in access and use of GuruKool due to a geographical change in Your location. You will be solely liable for accessing and using GuruKool in the countries of Your use.

5.7 GuruKool shall have the discretion to make certain or all Subscription Content available to You on either one or a limited number of End User devices concurrently.

6.Ownership

6.1 The Content on GuruKool and the "GuruKool" word mark and design mark, as well as certain other names, logos, and materials displayed on or through GuruKool Services that constitute trademarks, trade names, service marks or logos ("Marks"), are owned by or licensed to ZBEL and are subject to copyright, trademark, and other intellectual property rights under Indian and/or applicable law. You agree not to reproduce, duplicate, copy, download, stream capture, archive, upload, publish, broadcast, sell, resell, modify, translate, decompile, disassemble, reverse engineer or exploit for any purpose the GuruKool Services or any portion thereof, including the Content and Marks, except as authorized by these Terms of Use or in writing by ZBEL. You are strictly prohibited from creating derivative works or materials otherwise derived from or based on the Content and Marks, including montages, mash-ups and similar videos, wallpapers, desktop themes, greeting cards, and merchandise, except as authorized. You must abide by all copyright notices, information, and restrictions associated with any Content, and must not remove, alter, interfere with, or circumvent any copyright, trademark, or other proprietary notices or digital rights management mechanisms (including geo-filtering and/or encryption) associated with the Content.

6.2 You hereby agree that all intellectual property rights, title and interest in End User-generated content published or generated on GuruKool Services by You shall vest with ZBEL.

7.Restrictions

7.1 GuruKool Services is provided for Your personal, non-commercial use only. You agree not to, either directly or through any device, software, web-based service, or other means, copy, download, archive, perform, display, upload, publish, transmit or retransmit the Content, or create any derivative work or material based on it, rent, lease, duplicate, sublicense, assign, pledge, loan, or resell the Content of GuruKool. You shall not translate, reverse engineer, decompile or disassemble GuruKool Services, and shall only use GuruKool Services on a Device under Your exclusive control and ownership. You shall not permit any third party to benefit from the use or functionality of GuruKool Services, whether directly or via any facility management, timesharing, service bureau or similar arrangement. Transferring possession of any copy of GuruKool Services to another party will automatically terminate Your subscription. All rights not expressly set forth herein are reserved exclusively by ZBEL.

7.2 You are prohibited from using technology or other means to access, index, frame, or link GuruKool Services, in whole or in part, in a manner not authorized by ZBEL.

7.3 You agree not to use GuruKool Services for promoting the services of ZBEL's competitors.

7.4 You expressly agree to use GuruKool Services in strict compliance with applicable laws.

7.5 Your use of GuruKool Services shall be strictly governed by the following binding principles. If You are accessing and/or residing in India, You shall not host, display, upload, modify, publish, transmit, update or share any information that:

1. belongs to another person and to which You have no right, or that interferes with another End User's use and enjoyment of GuruKool Services;
2. is harmful, harassing, blasphemous, defamatory, obscene, pornographic, libellous, invasive of another's privacy, hateful, or ethnically objectionable, disparaging, or relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever, including but not limited to content constituting "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
3. is misleading in any way;
4. is patently offensive to the online community, such as content that promotes paedophilia, racism, bigotry, or physical harm of any kind against any group or individual;
5. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing or spamming;
6. infringes intellectual property rights of a third party or violates privacy rights (including unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity;
7. contains restricted or password-only access pages, or hidden pages or images;
8. provides material that exploits people in a violent or otherwise inappropriate manner, or solicits personal information from anyone;
9. provides instructional information about illegal activities such as making or buying illegal weapons or creating computer viruses;
10. contains video, photographs, or images of another person without their express written consent (or that of their guardian, in the case of a minor);
11. engages in commercial activities and/or sales without Our prior written consent, such as contests, sweepstakes, barter, or advertising. "Prior written consent" means a communication from Our authorized representative, specifically in response to Your request and specifically addressing the activity for which You seek authorization;
12. harms minors in any way;
13. violates any law for the time being in force;
14. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, public order, or incites the commission of any cognizable offence, prevents investigation of any offence, or is insulting to any other nation;
15. contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
16. is patently false and untrue, published with the intent to mislead or harass a person, entity or agency for financial gain or to cause injury.

7.7 You shall not use any "deep-link," "page-scrape," "robot," "spider" or other automatic device, program, algorithm or methodology, or any equivalent manual process, to access, acquire, copy or monitor any portion of GuruKool or any Content, or to reproduce or circumvent the navigational structure or presentation of GuruKool or any Content, in order to obtain materials, documents or information not purposely made available through GuruKool. We reserve the right to bar any such activity.

7.8 You shall not probe, scan or test the vulnerability of the GuruKool website or any connected network, nor breach any security or authentication measures. You may not reverse look-up, trace or attempt to trace any information about any other End User or visitor to its source.

7.9 You agree not to take any action that imposes an unreasonable or disproportionately large load on the infrastructure of GuruKool Services or connected systems or networks.

7.10 You may not forge headers or otherwise manipulate identifiers to disguise the origin of any message or transmittal sent to Us, and may not pretend to be, or impersonate, any other individual or entity.

7.11 You shall not engage in advertising to, or solicitation of, other End Users to buy or sell any products or services, including those displayed on or related to GuruKool Services.

7.12 Your dealings with, or participation in promotions of, third-party advertisers found on or through GuruKool Services — including payment and delivery of goods or services and any related terms, conditions or warranties — are solely between You and such third party. We are not responsible or liable for any loss or damage arising from such dealings or the presence of such advertisers on GuruKool Services, including the availability, accuracy, content, products or services of any linked third-party websites or resources. Links to such resources do not imply endorsement by ZBEL.

7.13 Other End Users (including unauthorized users or "hackers") may post or transmit offensive or obscene materials on GuruKool, and You may be involuntarily exposed to such content or have Your personal information obtained by others through the public forum, potentially resulting in harassment. We do not approve of such unauthorized uses, but by using GuruKool You acknowledge that We are not responsible for the use of any personal information You publicly disclose or share with others on GuruKool. Please carefully select the type of information You share publicly.

7.14 You give GuruKool express rights and consent to display Your comments in relation to relevant Content on the GuruKool Application/website, including making them available to other members for viewing.

7.15 GuruKool reserves the right to remove Your comments in relation to relevant Content at its sole discretion and/or upon request of any third party, where such comments may create liability for GuruKool or harm its reputation and/or goodwill.

8.Termination

Your right to use GuruKool Services shall automatically terminate if You violate these Terms of Use or any related terms, rules or guidelines. ZBEL reserves the right, in its sole discretion, to suspend or terminate Your access to all or any part of GuruKool, for any reason, with or without notice. As a subscription-based End User, Your right to use GuruKool shall also automatically terminate on expiry of the term of the Subscription Package. You may discontinue Your participation in and access to GuruKool Services at any time. You agree that upon suspension or termination, no amount shall be refunded to You by ZBEL.

9.Feedback

ZBEL welcomes and encourages You to provide feedback, comments and suggestions for improvements to GuruKool Services ("Feedback"). You may submit Feedback by emailing us at support@bulletshorts.com. You acknowledge and agree that all Feedback will be the sole and exclusive property of ZBEL, and You hereby irrevocably assign to ZBEL all Your right, title, and interest in and to all Feedback, including all worldwide patent, copyright, trade secret and other proprietary or intellectual property rights therein. At ZBEL's request and expense, You will execute documents and take further action as reasonably requested to help ZBEL acquire, perfect, and maintain its intellectual property rights and legal protections for the Feedback. ZBEL shall not be under any obligation to act on Feedback provided by You, and may decide at its sole discretion whether any action is required. You agree to indemnify and hold ZBEL harmless against any liabilities suffered or incurred as a consequence of any action taken pursuant to Your Feedback.

10.Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GuruKool SERVICES IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. YOU ASSUME SOLE RISK AND RESPONSIBILITY FOR SELECTING GuruKool SERVICES TO ACHIEVE YOUR INTENDED RESULTS, AND FOR THE INSTALLATION OF, USE OF, AND RESULTS OBTAINED FROM GuruKool SERVICES. ZBEL MAKES NO WARRANTY THAT GuruKool SERVICES WILL BE ERROR-FREE, VIRUS-FREE, OR FREE FROM INTERRUPTIONS OR OTHER FAILURES, OR THAT IT WILL SATISFY YOUR SPECIFIC REQUIREMENTS OR THAT ERRORS WILL BE RECTIFIED. YOU UNDERSTAND THAT GuruKool SERVICES CAN BE BLOCKED OR MADE INOPERABLE, AND ZBEL ASSUMES NO RESPONSIBILITY OR LIABILITY FOR THE SAME. GuruKool SERVICES IS NOT FAULT-TOLERANT AND IS NOT DESIGNED OR INTENDED FOR USE IN HAZARDOUS ENVIRONMENTS REQUIRING FAIL-SAFE PERFORMANCE, INCLUDING WITHOUT LIMITATION THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, WEAPONS SYSTEMS, OR DIRECT LIFE-SUPPORT MACHINES, OR ANY OTHER APPLICATION IN WHICH FAILURE OF THE GuruKool NETWORK COULD LEAD DIRECTLY OR INDIRECTLY TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR PROPERTY DAMAGE ("HIGH RISK ACTIVITIES"). ZBEL EXPRESSLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTY OF FITNESS FOR HIGH RISK ACTIVITIES.

11.Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ZBEL, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS AND AGENTS ("INDEMNIFIED PARTIES") FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, EXPENSES AND FEES (INCLUDING REASONABLE ATTORNEYS' FEES AND COSTS) THAT SUCH INDEMNIFIED PARTIES MAY INCUR ARISING FROM: (A) ANY INFORMATION (INCLUDING YOUR END USER GENERATED CONTENT, FEEDBACK, OR OTHER CONTENT) YOU OR ANYONE USING YOUR ACCOUNT SUBMITS, POSTS, OR TRANSMITS ON OR THROUGH GuruKool SERVICES; (B) YOUR OR ANYONE USING YOUR ACCOUNT'S USE OF THE GuruKool SERVICES; (C) YOUR OR ANYONE USING YOUR ACCOUNT'S VIOLATION OF THESE TERMS OF USE; OR (D) YOUR OR ANYONE USING YOUR ACCOUNT'S VIOLATION OF ANY RIGHTS OF ANY OTHER PERSON OR ENTITY, INCLUDING ANY COPYRIGHT, PATENT, TRADEMARK, TRADE SECRET OR OTHER PROPRIETARY RIGHTS. ZBEL RESERVES THE RIGHT, AT ITS OWN EXPENSE, TO ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF ANY MATTER OTHERWISE SUBJECT TO INDEMNIFICATION BY YOU, IN WHICH EVENT YOU WILL COOPERATE WITH ZBEL IN ASSERTING ANY AVAILABLE DEFENSES.

12.Limitation of Liability

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, SHALL ZBEL BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, REMOTE OR CONSEQUENTIAL DAMAGES OR ANY OTHER DAMAGES WHATSOEVER (INCLUDING DAMAGES FOR LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF CONFIDENTIAL OR OTHER INFORMATION, BUSINESS INTERRUPTION, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, PERSONAL INJURY, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY INCLUDING A DUTY OF GOOD FAITH OR OF REASONABLE CARE, NEGLIGENCE, AND ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OR INABILITY TO USE GuruKool, LOSS OF DATA, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THESE TERMS OF USE, EVEN IN THE EVENT OF FAULT, TORT (INCLUDING NEGLIGENCE AND GROSS NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT, OR BREACH OF WARRANTY BY ZBEL, AND EVEN IF ZBEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL ZBEL BE LIABLE FOR ANY DAMAGES IN EXCESS OF YOUR LAST RECHARGE AMOUNT FOR GuruKool. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT THAT APPLICABLE LAW PROHIBITS SUCH LIMITATION. THE FOREGOING PROVISIONS SHALL BE ENFORCEABLE TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

13.Privacy Policy

All information provided by You or collected by Us shall be governed in accordance with the Privacy Policy located at gurukool.co.in/privacy.

14.Relationship

The relationship between ZBEL and You is on a principal-to-principal basis. You are in no way ZBEL's legal representative, partner or agent for any reason whatsoever.

15.Export Laws

You agree to comply fully with applicable export laws and regulations to ensure that GuruKool is not exported or re-exported, directly or indirectly, in violation of, or used for any purposes prohibited by, such laws and regulations.

16.Confidentiality

You agree that GuruKool, including but not limited to its object code components, provided to You is "Confidential Information" of ZBEL. You shall retain all Confidential Information in strict confidence, with at least the same diligence You exercise in preserving the secrecy of Your own most valuable information, but in no event less than reasonable diligence.

17.Assignment

These Terms of Use are personal to You, and You shall not assign, transfer, sub-contract or otherwise part with these Terms of Use or any right or obligation under it without ZBEL's prior written consent. Any attempt to do so without such consent will be null and void. ZBEL may assign or transfer these Terms of Use to any third party, at its sole discretion, without restriction. Subject to the foregoing, these Terms of Use will bind and inure to the benefit of the parties, their successors, personal representatives and permitted assigns.

18.Severability

If any provision of these Terms of Use is held to be unenforceable, the enforceability of the remaining provisions shall in no way be affected or impaired.

19.Waiver

The failure of ZBEL to enforce or exercise, at any time or for any period, any term of or right pursuant to these Terms of Use shall not be construed as a waiver of such right and shall not affect ZBEL's right to later enforce or exercise it.

20.Electronic Communication

When You use or send any data, information or communication to ZBEL, You agree and understand that You are communicating with ZBEL through electronic records, and You consent to receive communications via electronic records from ZBEL periodically and as required. ZBEL will communicate with You by email or any push or other message or electronic record, on the email address and/or mobile number available with ZBEL, which will be deemed adequate service of notice/electronic record.

21.Notice

21.1 Any notices or other communications required will be in writing and emailed to ZBEL at support@bulletshorts.com. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.

21.2 If You have any complaints with respect to any Content on GuruKool, please write to us at support@bulletshorts.com with details of the objectionable content and Your details, including Your name, mobile number, and such other details as may be requested. Based on the complaint raised, We will take reasonable measures to resolve the issue. You expressly agree that ZBEL shall under no circumstances be liable to You for any damages whatsoever, and that ZBEL makes no representation that any complaint raised by You will be resolved to Your satisfaction. All steps taken by ZBEL in this regard shall be at its sole discretion.

22.Class Action Waiver and Disputes

WHERE PERMITTED UNDER APPLICABLE LAW, YOU AND ZBEL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, where permitted under applicable law, unless both You and ZBEL agree otherwise, the court may not consolidate more than one person's claims with Your claims and may not otherwise preside over any form of representative or class proceeding.

Save as provided hereunder, these Terms of Use and all matters arising from them are governed by and construed in accordance with the laws of India, and the courts of Mumbai, India shall have exclusive jurisdiction over all disputes arising in connection with these Terms of Use.

23.Entire Agreement and Amendment

23.1 These Terms of Use expressly supersede and completely replace any and all prior Terms of Use. ZBEL shall not be bound by or liable to You for any pre-existing or contemporaneous written or oral representations or warranties made by anyone with respect to GuruKool, including any authorized agents, employees, or representatives.

23.2 ZBEL reserves the right, at its sole discretion, to modify these Terms of Use from time to time ("Updated Terms of Use"). The Updated Terms of Use shall be effective immediately and shall supersede these Terms of Use. ZBEL shall not be under any obligation to notify You of changes to the Terms of Use; You are solely responsible for reviewing the Terms of Use from time to time for modifications. Continuing to use GuruKool after the Updated Terms of Use have been published shall be deemed to constitute Your acceptance of them.
